Terms of Service
Commission Desk, a product of Oppatt Group LLC, doing business as Brokerage Simplified
Effective date: October 16, 2026 · Last updated: October 17, 2026
These terms are an agreement between Oppatt Group LLC, doing business as Brokerage Simplified ("we", "us"), and the brokerage or business that buys a Commission Desk license ("you"). By buying a license or using Commission Desk, you agree to these terms and to our Privacy Policy. The person accepting these terms confirms that they have authority to bind the brokerage.
1. What Commission Desk is
Commission Desk is web-based software that helps a real estate brokerage track agent commission plans, closings, caps, payments, pay stubs, statements and related reports. It runs on Google Apps Script and stores your records in a Google Sheets file in your own Google Drive.
2. Your license
When you pay, we give you a limited, non-exclusive, non-transferable license to use Commission Desk for one brokerage for the license term you bought.
- Admin seats: each license includes 2 admin seats. An admin can be any Google account email. You can change which emails hold the seats yourself in Settings.
- One brokerage per license: a license covers one brokerage business, including its agents. A separate brokerage, franchise or company needs its own license, even if it's owned by the same person.
- No sharing: you may not share admin seats or sign-ins with people outside your brokerage, or let others use your license.
- No resale or copying: you may not sell, rent, sublicense or transfer Commission Desk, copy it, or build a competing product from it. You may not try to get around the license check or reverse-engineer the software.
Agents don't sign in to Commission Desk. They receive pay stubs and statements by email when an admin sends them.
3. Your Google account
Commission Desk needs a Google account for each admin. You're responsible for keeping those accounts secure (we recommend 2-step verification) and for everything done in Commission Desk through them. Tell us promptly if you think an admin account has been misused.
4. Your data
- You own your records. Your brokerage's records stay in your Google Drive. We don't have access to them. See the Privacy Policy for the little information we do keep.
- You're responsible for what you enter and for having the right to use it, including agents' names, email addresses and pay information.
- Back-ups: your records file is a normal Google Sheets file. Google keeps version history, and you can make your own copy at any time. We can't recover a records file that you or someone with access deletes or changes.
- When your license ends, your records file stays in your Drive and you can still open it in Google Sheets. The Commission Desk app will stop opening for your admins.
5. Price and payment
- Price: $69 per month or $690 per year per brokerage, as shown at checkout. The price is per brokerage, not per agent or per closing.
- What's included:
- 2 admin seats
- up to 30 active agents (agents marked Inactive or archived don't count)
- unlimited closings, pay stubs and statements
- updates and email support
Brokerages that need more active agents can ask us for a quote.
- Optional setup help: $199 one-time.
- Payment is made through our payment processor, Stripe. You authorize us to charge your payment method for the plan you choose.
- Renewal: your subscription renews automatically each month or year, at the current price for your plan, unless you cancel before the renewal date.
- We'll email you at least 30 days before a yearly renewal.
- We'll tell you in advance of any price increase.
- Taxes: prices don't include sales tax. We'll add tax where the law requires it.
- Late or failed payment: if a payment fails, our payment processor will retry it and email you. If it still hasn't gone through after 14 days, we may pause your license until it's paid. Your records file is not affected.
6. Refunds
- 30-day money-back guarantee: if Commission Desk isn't right for you, email us within 30 days of your first payment for a full refund of that payment.
- After that, payments are non-refundable, except where the law requires otherwise.
Setup help is non-refundable once the setup session has taken place.
Cancelling a subscription stops future charges. You keep access until the end of the period you already paid for. We don't give partial refunds for unused time, unless the law requires it.
7. Optional setup help
If you buy setup help, we meet with you by screen-share and guide you while you control your screen and enter your information. We don't take copies of your records or ask for your passwords. You stay responsible for checking that the plans and balances entered match your agreements with your agents.
8. Updates and support
- Updates: Commission Desk is one shared app, so improvements and fixes reach everyone automatically. Your records file isn't replaced by an update. We may add, change or remove features. If we remove a major feature you rely on, we'll tell you in advance.
- Support: email support@brokeragesimplified.com. We aim to reply within 2 business days. Support covers how to use Commission Desk. It doesn't cover tax, legal or accounting advice.
- Availability: Commission Desk depends on Google's services. We don't promise it will always be available or error-free, and Google outages or changes may affect it.
9. Acceptable use
You agree not to use Commission Desk to:
- break any law, including privacy, anti-spam, real estate licensing or employment laws
- send email to people who haven't agreed to receive it from your brokerage, or send content unrelated to commissions and payments
- upload harmful code, overload the service, or try to reach other customers' information
- get around the license check or the admin-seat limit
We may pause a license that is being misused. Where we can, we'll contact you first.
10. Important: Commission Desk is a tool, not professional advice
- Check before you pay. Commission Desk calculates splits, fees, caps and balances from the plans and numbers you enter. You're responsible for checking every amount before you pay an agent or send a statement. We're not responsible for payments made from figures you didn't check.
- Not tax, legal or accounting advice. Reports, year-end statements and any 1099-related summaries are to help you keep records. They are not tax forms and don't replace a qualified tax professional. You're responsible for your tax filings, including Form 1099-NEC.
- CDAs and other documents. Commission disbursement authorizations and other documents Commission Desk creates are based on your input. You're responsible for making sure they are correct, are signed as required, and meet your state's rules, your title or closing company's requirements, and your brokerage's agreements.
- Your agreements come first. If anything in Commission Desk differs from your written agreements with your agents, your agreements control.
- Email delivery. Emails are sent from your Google account and are subject to Google's sending limits. We can't guarantee that every email will be delivered or read.
11. Disclaimer of warranties
COMMISSION DESK IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THAT COMMISSION DESK WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE AT ALL TIMES.
12. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, INCORRECT PAYMENTS TO AGENTS, TAX PENALTIES OR BUSINESS INTERRUPTION, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO COMMISSION DESK IS LIMITED TO THE AMOUNT YOU PAID US FOR COMMISSION DESK IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some places don't allow some of these limits, so they may not all apply to you.
13. Indemnity
You agree to defend and indemnify us against claims by third parties (including your agents) arising from your records, your payments to agents, your use of Commission Desk in breach of these terms, or your breach of any law.
14. Ending the agreement
- You can cancel at any time by emailing us.
- We can end or pause your license if you seriously break these terms, or don't pay after notice. If we stop offering Commission Desk altogether, we'll give at least 60 days' notice and refund any prepaid fees for the unused period.
- After the agreement ends, sections 4 (your data), 10 to 13, 15 and 16 continue to apply.
15. Changes to these terms
We may update these terms. We'll post the new version with a new date and, for important changes, email license holders at least 30 days before they take effect. If you keep using Commission Desk after that, the new terms apply. If you don't agree, you can cancel before they take effect and receive a pro-rated refund for prepaid time.
16. General
- Governing law: the laws of the State of South Carolina govern these terms. Any dispute will be handled in the state or federal courts in Greenville County, South Carolina.
- Whole agreement: these terms and the Privacy Policy are the whole agreement about Commission Desk.
- If part is invalid, the rest still applies.
- No waiver: if we don't enforce a term right away, we can still enforce it later.
- Assignment: you may not transfer this agreement without our written consent. We may transfer it as part of a sale or reorganization of our business.
- Notices: we'll send notices to your account owner's email. Send notices to us at support@brokeragesimplified.com.
- Google: Commission Desk is not made, endorsed or supported by Google. Google, Google Sheets and Google Drive are trademarks of Google LLC.
